Terms of service
Last updated 9 October 2026
Agreement
These terms govern access to and use of the Tulip Coffee Company preview website at tulipcoffee.org and www.tulipcoffee.org (the "Site"), including the waitlist and related emails. By using the Site you agree to these terms. If you do not agree, do not use the Site.
The Site is operated by Tulip Coffee Company, Adelaide, South Australia. Contact: [email protected] or [email protected].
What this site is
The Site is a preview and marketing surface for Tulip’s software and learning for the coffee industry. It is informational. Nothing on the Site is an offer to sell coffee, roasting services, or any physical product. Tulip does not sell or roast coffee on this Site.
Joining the waitlist records your interest and consent to hear from us. It is not a purchase, subscription contract, partnership, employment offer, or guarantee that any product will launch, that you will receive access, or that any feature, price, or timeline shown in marketing will match the final product.
Acceptable use
You may use the Site only for lawful purposes and in a way that does not harm Tulip, other users, or the Site’s security. You must not attempt to bypass security or rate limits, submit automated or deceptive waitlist entries, scrape the Site at a volume that degrades service, introduce malware, or use the Site to send spam or infringe others’ rights.
We may refuse, suspend, or remove waitlist entries, block access, or take other steps we reasonably consider necessary to protect the Site, our systems, or our users.
Intellectual property
The Site’s design, text, logos, brand marks, video, graphics, and software are owned by Tulip or its licensors. You receive a limited, revocable licence to view the Site for personal or internal business evaluation. You may not copy, modify, distribute, reverse engineer, or create derivative works from Site materials except as allowed by law or with our prior written consent.
"Tulip Coffee Company", related marks, and the tulip device are trademarks of Tulip. Third-party names (including Google, YouTube, Instagram, and LinkedIn) belong to their owners.
Third-party services and links
The Site may link to YouTube, Instagram, LinkedIn, Google policies, and other third-party sites. Those services are governed by their own terms and privacy policies. Tulip is not responsible for their content, availability, or practices.
reCAPTCHA and, if you accept analytics cookies, Google Analytics are provided by Google and are subject to Google’s terms and privacy policy.
Privacy
Personal information is handled as described in our Privacy notice. By submitting the waitlist form you confirm that the email address is yours (or that you are authorised to use it) and that you agree to receive the emails described in the consent text.
Disclaimers
The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Tulip disclaims all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that waitlist or email delivery will be timely or successful in every case.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other law that cannot be excluded. Where such a guarantee applies and a failure is not a major failure, Tulip’s liability is limited, at our option, to resupplying the services or paying the cost of having the services supplied again.
Limitation of liability
To the maximum extent permitted by law, Tulip and its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive loss, or for loss of profits, revenue, data, goodwill, or business opportunity, arising from or related to the Site or these terms, whether in contract, tort (including negligence), statute, or otherwise.
To the maximum extent permitted by law, Tulip’s total aggregate liability for all claims arising from or related to the Site or these terms is limited to AUD 100, or the amount you paid us to use the Site in the 12 months before the claim (which is currently nil), whichever is greater. These limits apply even if a remedy fails of its essential purpose, and they do not limit liability that cannot be limited under applicable law.
Indemnity
You agree to indemnify and hold harmless Tulip and its officers, employees, and contractors from reasonable losses, damages, and expenses (including legal costs on a solicitor–client basis) arising from your misuse of the Site, your breach of these terms, or your infringement of another person’s rights, except to the extent caused by Tulip’s fraud or wilful misconduct.
Changes, law, and contact
We may update these terms by posting a revised version on the Site. The “Last updated” date will change. Continued use after an update constitutes acceptance of the revised terms for future use of the Site. If a change is material to the waitlist, we will update this page before applying it to new signups.
These terms are governed by the laws of South Australia and the Commonwealth of Australia. Subject to any non-excludable consumer rights, the courts of South Australia have non-exclusive jurisdiction.
If any part of these terms is unenforceable, the rest remains in effect. These terms, together with the Privacy notice, are the entire agreement between you and Tulip about the Site. Questions: [email protected] or [email protected].
